1. Introduction

Welcome to Mihaan Automation (“Mihaan Automation,” “we,” “us,” or “our”). These Terms govern your access to and use of our Services.

2. Acceptance of Terms

These Terms form a legally binding agreement between you (an individual or entity) and Mihaan Automation concerning your access to and use of https://mihaan.tech and any related media, channels, or applications (collectively, the “Site”). We are registered in Mumbai, India. By accessing the Site, you acknowledge you have read, understood, and agree to be bound by these Terms and by our User Agreement, which is incorporated by reference.

If you do not agree with these Terms, you must discontinue use immediately.

We may update these Terms at our discretion. When we do, we will revise the “Last updated” date above. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.

The Site is intended for users at least 13 years of age; minors must use the Site only with the consent and supervision of a parent or legal guardian. Certain industries (e.g., HIPAA, FISMA, GLBA) are not supported; do not use the Site in ways that would require such compliance.

3. Changes to the Terms

You agree to provide accurate, current billing details and authorize charges in INR or USD as applicable, including recurring charges if you choose a subscription. Taxes may apply. Prices may change, and we may correct pricing errors even after payment requests.

8. Cancellation

You may cancel subscriptions anytime via your account or by contacting us. Cancellation takes effect at the end of the current paid term. If you are unsatisfied, email founder@mihaan.tech.

9. User Content

By submitting content to the Services, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and distribute it in connection with the Services. You retain ownership of your content.

10. Intellectual Property

All intellectual property in the Services (software, text, graphics, logos, trademarks) is owned by Mihaan Automation or its licensors. You receive a limited, non-exclusive, non-transferable license for personal or internal business use. Do not copy, modify, distribute, or create derivative works without prior written consent.

11. Prohibited Activities

• Scraping or compiling Site content without permission.
• Attempting to obtain sensitive information or bypass security features.
• Harassing or harming others, or abusing support channels.
• Uploading malware, performing automated abuse (bots, scrapers), or excessive spamming.
• Reverse engineering, copying, or adapting Site software except as allowed by law.
• Creating unauthorized accounts or collecting user emails for unsolicited messages.
• Using the Site to compete with us or for prohibited commercial use.
• Selling or transferring your profile.

12. Social Media

You may link third-party accounts subject to those providers’ terms. If enabled, we may access and display information from those accounts per your settings. You can disable connections at any time via account settings or by contacting us.

13. Privacy

We care about data privacy and security. See our Privacy Policy. By using the Site, you consent to processing in India. We do not knowingly collect data from children under 13 and will delete such data if discovered.

14. Third-Party Services

We are not responsible for third-party websites or services linked from the Services. Your use of them is at your own risk.

15. Limitation of Liability

To the fullest extent permitted by law, Mihaan Automation and its affiliates, officers, directors, employees, and agents are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, data, use, or goodwill.

16. Indemnification

You agree to indemnify and hold harmless Mihaan Automation and its affiliates, officers, directors, employees, and agents from claims arising out of your use of the Services, your breach of these Terms, or your violation of third-party rights.

17. Termination

We may suspend or terminate access at any time with or without cause. Provisions that by nature survive termination (e.g., ownership, disclaimers, limitations of liability) will continue to apply.

18. Governing Law

These Terms are governed by the laws of India. Courts in Mumbai, India, have exclusive jurisdiction.

19. Dispute Resolution

Disputes will be resolved by binding arbitration in Mumbai, India, under the rules of a mutually agreed arbitration institution. The arbitrator’s decision is final, and judgment may be entered in any competent court.

20. Severability

If any provision is unenforceable, the remainder remains in effect, and a valid substitute term reflecting the original intent will apply.

21. Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and Mihaan Automation. Failure to enforce a provision is not a waiver.

Refund Policy

1. Trial Period

New users receive a 14-day free trial of the Basic Plan and a 14-day trial of Chatbot Flows (add-on). No credit card is required during the trial.

2. Subscription Services

After the free trial, paid subscriptions are non-refundable. The trial is intended for evaluation. You may cancel anytime during the trial to avoid charges. If you subscribe to any plan, you can cancel to avoid future renewals, but past charges are not refunded.

3. Non-Refundable Services

Charges for Mihaan Automation plans, WhatsApp Conversation Credits (WCCs), add-ons, third-party integrations, one-time chatbot development, and other setup fees are non-refundable.

4. Technical Issues

If continuous technical issues prevent effective use and are verified by our support team, a partial or full refund may be granted at our discretion.

5. Unauthorized Charges

Report suspected unauthorized or fraudulent charges immediately. If verified, we will issue a full refund.

6. Cancellation Policy

You may cancel your subscription at any time. Cancellation becomes effective at the end of the current billing cycle. Refunds for the remaining period are not provided except under special, case-by-case circumstances.

8. Refund Process
